Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") are a binding agreement between you and Wyldfyre ("Wyldfyre," "we," "us," or "our") governing your access to and use of the Wyldfyre website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by all of these Terms. If you do not agree, you may not use the Service.

We may change these Terms at any time. We indicate changes by updating the "last updated" date above, and your continued use of the Service after changes take effect means you accept the revised Terms. It is your responsibility to review these Terms periodically.

2. Eligibility

You must be at least 18 years old to create an account or use the Service. By using the Service, you represent and warrant that you are 18 or older, that you have the legal capacity to enter into these Terms, and that your use of the Service complies with all laws that apply to you.

3. The Service and play money

Wyldfyre is a free, play-money game for entertainment, educational, and informational purposes. The Service lets you make predictions in play-money markets about California wildfire activity using virtual points ("Play Money").

  • Play Money has no cash or redeemable value and cannot be purchased, cashed out, withdrawn, sold, traded, gifted, or exchanged for real money or anything else of value.
  • Play Money is not legal tender, electronic money, a security, a commodity, a financial instrument, or any other thing of monetary value.
  • All Play Money remains our property. You receive only a limited, revocable, non-transferable license to use it within the Service, and you acquire no ownership or proprietary interest in it.
  • We may credit, debit, modify, expire, or eliminate Play Money balances, and add, change, or discontinue features of the Service, at any time and for any reason without notice or liability.

Because there is no purchase, deposit, wager, or payout of any kind, the Service is not real-money gambling, investing, or financial trading, and is not operated under, or subject to, financial- services or gambling regulations.

4. Markets, resolution, and no advice

Market prices, probabilities, forecasts, and other information on the Service are generated by user activity and third-party data and are provided for informational and entertainment purposes only. Nothing on the Service is financial, investment, trading, gambling, legal, or other professional advice, or a recommendation to take any real-world action.

All market creation, resolution, re-resolution, cancellation, and voiding of positions are ultimately at our sole and absolute discretion. We may resolve, re-resolve, cancel, or void any market at any time and for any reason — including data errors, ambiguity, or suspected abuse — and you have no legal recourse against us for any such decision.

5. Not an emergency or safety information source

The Service displays fire-related data and crowd-generated forecasts for entertainment only. It is not an official source of emergency, evacuation, or fire-safety information and may be inaccurate, delayed, or incomplete. Do not use Wyldfyre to make any safety, evacuation, property, or firefighting decision. Always rely on CAL FIRE, local fire and emergency authorities, and official alerts.

6. Accounts and your representations

To use certain features you must register for an account. You agree to provide accurate, current information, to keep your credentials confidential, and that you are responsible for all activity under your account. Notify us promptly of any unauthorized use. We may remove or reclaim a username that is inappropriate, obscene, or otherwise objectionable, and we may suspend or terminate accounts that violate these Terms.

You represent and warrant that you will not access or use the Service through automated means except through any public interface we expressly provide, and that you will comply with all applicable laws.

7. Prohibited activities

You agree that you will not:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Use the Service to promote, encourage, or facilitate illegal activity — including intentionally starting or spreading fires — or to interfere with or obstruct emergency response;
  • Manipulate markets, collude, exploit bugs, operate multiple or automated accounts, or otherwise abuse the play-money mechanics;
  • Use any automated system (bot, scraper, crawler, or the like) to access the Service, except through a public API we expressly provide and subject to its limits;
  • Systematically retrieve, copy, reproduce, resell, or create derivative works from the Service or its data except as expressly permitted;
  • Interfere with, disrupt, or place undue load on the Service, or attempt to gain unauthorized access to the Service, other accounts, or our systems;
  • Upload viruses or malicious code, harass or abuse others, impersonate any person, or remove any proprietary notices.

8. Data and third-party content

The Service incorporates data from third-party and public sources, including NASA FIRMS, NIFC, CAL FIRE, the U.S. Census Bureau, and Mapbox. That data is provided by those sources "as is," may be subject to their own terms, and we make no warranty about its accuracy, completeness, or timeliness. Third-party names and marks belong to their owners, and their inclusion does not imply endorsement. We are not responsible for third-party websites or content that the Service may link to; you access them at your own risk.

9. User contributions and feedback

You are responsible for any content you submit (such as a display name or comments), and you represent that it does not violate any law or third-party right and is not obscene, harassing, defamatory, or otherwise objectionable. We may edit, remove, or refuse any content at any time, without notice. Any feedback, ideas, or suggestions you send us are non-confidential, and you grant us an unrestricted, royalty-free, perpetual license to use them for any purpose without compensation or attribution.

10. Intellectual property

The Service and its content — excluding third-party content and your contributions — are owned by us and protected by intellectual-property laws. We grant you a limited, revocable, non-transferable, non-exclusive license to access and use the Service for its intended personal, non-commercial purpose. You may not otherwise copy, reproduce, distribute, sell, reverse engineer, or commercially exploit the Service without our written permission.

11. Site management and termination

We reserve the right, in our sole discretion and without notice or liability, to monitor the Service for violations, take appropriate legal action, restrict or remove content, and manage the Service to protect our rights and property. We may deny access to, suspend, or terminate your use of the Service, or delete your account, at any time, for any reason or no reason, without warning. After termination you may not register a new account without our permission.

12. Modifications and interruptions

We may change, modify, suspend, or discontinue all or part of the Service at any time, for any reason, without notice. We do not guarantee that the Service will be available at all times, and we will not be liable to you or any third party for any modification, suspension, or discontinuance, or for any loss, damage, or inconvenience caused by your inability to access or use the Service.

13. Disclaimer of warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND YOUR USE OF IT IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICE OR ITS CONTENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE ASSUME NO LIABILITY FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR ANY LOSS ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE — EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

15. Indemnification

You agree to defend, indemnify, and hold harmless Wyldfyre and its officers, agents, and employees from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees, arising out of your use of the Service, your contributions, your breach of these Terms or your representations, or your violation of any law or third-party right.

16. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.

17. Dispute resolution

Informal resolution. Before filing any claim, you agree to first contact us at support@wyldfyre.io and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration. If we cannot resolve a dispute informally, it will be settled by binding individual arbitration administered by JAMS under its applicable rules, held in California or conducted remotely, rather than in court. Judgment on the award may be entered in any court with jurisdiction.

Class-action waiver. Disputes will be resolved only on an individual basis. You and we waive any right to bring or participate in a class, collective, or representative action.

Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief to protect its intellectual property. Any claim must be brought within one (1) year after it arises.

18. Electronic communications

By using the Service, you consent to receive communications from us electronically, including service and administrative messages and, where you have not opted out, occasional product updates. You agree that electronic communications, agreements, and records satisfy any legal requirement that such communications be in writing. You may opt out of non-essential emails using the unsubscribe link.

19. California residents

Under California Civil Code § 1789.3, California residents may reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or (800) 952-5210.

20. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service. Our failure to enforce any provision is not a waiver of it. If any provision is held unenforceable, the remaining provisions stay in effect. We may assign these Terms; you may not. Nothing here creates a partnership, joint venture, or employment relationship.
